Safety concerns continue to be voiced, but laborers are dying at a consistent pace. We need to do everything in our power to avoid these accidents in the future, but it is obviously too late for one construction worker in Queens who died in a tragic dumpster accident.

If you have been injured in a New York construction accident, you should get in touch with a personal injury attorney as soon as possible. With our help, you can explore your legal options with confidence. It may be possible to sue negligent parties directly, which will provide you with a considerable settlement. Alternatively, you can file a workers’ compensation claim with similar results. Family members can also take legal action on behalf of deceased loved ones who have died due to construction accidents.

Man Killed While Unloading Dumpster

On January 24th of 2022, it was reported that a man had been killed while unloading a dumpster in Queens. This individual was assisting with the unloading process when he was struck over the head by the large metal dumpster, causing fatal injuries. Not only that, but this individual was pinned between a house and the dumpster at the time of the death. A tragic scene then unfolded as family members mourned the death of their loved one at the place of the accident. This construction worker was just 32 years old at the time of his passing.

Filing a Wrongful Death Claim

In this situation, the family members of the deceased construction worker may file a wrongful death claim. This type of legal action allows family members to receive compensation for the death of their loved ones. This action is especially useful for surviving spouses who are trying to raise children alone, as it can provide them with compensation for missed future wages. In other words, the surviving spouse can continue to receive their loved one’s wages – even though the worker is no longer alive.

Wrongful death claims can also provide compensation for unpaid medical expenses. For example, a worker might have required extensive surgeries and medical procedures before finally succumbing to their injuries.

Finally, a wrongful death claim also provides families with compensation for funeral expenses. Families may also be able to claim non-economic damages depending on whether they are going through workers’ compensation.
